Maryland Natural Resources Police and the U.S. Coast Guard do not need a reason to board your vessel and many BUI/BWI cases begin as part of a routine inspection. Many of the field sobriety tests that are used on land have little or no validity on boaters whose "sea legs" affect their balance and equilibrium. New water-based sobriety tests are starting to be used, but marine police may have very little experience in administering these new tests correctly. Boaters can be asked to take a breath test and, like Maryland's DUI per se law, a test result of with a blood alcohol concentration of 0.08% or higher will result in a charge of "BUI per se." A first offense carries penalties of up to one year in jail, a $1,000 fine and the loss of your boating privileges in the State of Maryland for up to one year. The results of your breath test for a boating offense do not affect your license to drive a motor vehicle.
